About Trilobe General Terms & Conditions of sale
The website of Trilobe, whose address is https://www.trilobe.com (hereinafter the “Site”), is an e-commerce platform created, developed and managed by Trilobe (hereinafter “Trilobe” or “we”), is a French company whose registered office is located at 32 avenue de l’opéra, 75002 Paris, France, registered in the Paris Trade and Companies Registry under number 827 588 070. These General Terms & Conditions of Sale (“GTCS”) create a contract between the customer (hereinafter the “Customer”, “you” or “your”) and Trilobe. The Customer is an end consumer, a natural person (and not a company) who purchases the Products for any purpose other than professional use, resale or distribution. All purchases for professional use, resale or distribution are strictly prohibited, and anyone who does not meet the definition of Customer should contact Trilobe Customer Service at cercle@trilobe.com for further information regarding Trilobe’s selective distribution network. Please read these GTCS carefully to ensure that you, as a Customer, understand each of its provisions correctly. By placing an order for Products and/or Services (hereinafter the “Services”) on the Site or through any other means offered by Trilobe, you agree to be contractually bound to Trilobe and to be bound by the provisions of these GTCS, the Trilobe General Terms & Conditions of Use and Privacy Policy which generally apply to any use of the Site. Trilobe reserves the right to modify these GTCS at any time and at its sole discretion.
General terms & Conditions of sale updates
We may modify these General Terms & Conditions of Sale at any time. Therefore, please check them regularly to be kept informed of updates. The latest version of these General Terms & Conditions of Sale will always be available on the Site. Any new version of these General Terms & Conditions of Sale shall take effect immediately on the date of publication and shall govern all orders for products or services placed from that date. Any changes made to the General Terms & Conditions of Sale after you have placed your order will have no impact on that order or on your relationship with us, unless required by applicable law.
General terms & Conditions of purchase
Only natural persons (and not legal entities) who (a) have reached the age of legal majority required to enter into contracts (eighteen years of age in most countries); (b) have the legal capacity to enter into contracts; and (c) use a shipping address in the country(ies) we serve (as indicated by the Sales Channels), may order products. If you have not reached the age of legal majority or if for any other reason you do not have the legal capacity to enter into contracts, one of your parents or guardian will have to place your order on your behalf, and will be asked to accept these General Terms & Conditions of Sale. By placing an order through our Site, you represent and warrant that you are a bona fide customer and end user making a purchase for your own use or the personal use of a third party, and that you will not deliver, sell or otherwise distribute our products, or purchase our products or services for commercial purposes.
Product availability & quantity ordered
All orders placed through our Site are subject to availability and our acceptance of such orders. To obtain information about the ordering process, please refer to our Ordering Process section below. Quantity limits may apply to orders for certain products. We reserve the right to refuse at any time, without notice, orders exceeding a certain number of authorized products.
Account registration & Validation of visitor purchases
To place an order, you can either register and create an online account or place an order as a guest without creating an online account. When you place an order as a guest, we may still create an account in our internal systems to record your purchase(s).
Personalized services and products
Personalization services (i. e. wristband size) or other services can be offered on a selection of our products. If you wish to have your product customized, please provide the information requested during the sales process. We reserve the right to withhold or refuse acceptance of any order for personalized products or products accompanied by a gift card containing unacceptable, illegal content or contrary to our policies. It is your responsibility to ensure the accuracy of any mention you provide regarding the products to be customized. In addition, orders for customized products, including our Secret watch with its personalized starry sky, are not cancellable and products that have been customized, in one way or another, cannot be returned to us for exchange or refund, as described in these General Terms & Conditions of Sale. This clause does not affect your consumer rights (please refer to the Manufacturer’s Warranty section and your legal rights as a consumer for more information).
Ordering process
The Platform ordering process will include the following steps: Add to cart: once you have chosen a product, you can add it to your cart. You can then decide to continue shopping and add other items to your shopping cart (subject to availability and quantity limits). Putting an item in your shopping cart does not guarantee its availability at the time of purchase which is only confirmed once you have received a written order confirmation. Validation of purchases /My Account: when you are ready, you then move on to “Validation”. You can also remove from the shopping cart one or more products that you selected during the validation process. Shipping details, verification and payment: during the validation process, you add and verify your order details and personal information (including email address, shipping address, billing address and payment details). You must carefully check and confirm all details appearing on the order summary page before placing your order. Placing the order: you then tick the corresponding box and place your order. If an order is placed through the Customer Relations Center, the Trilobe Ambassador will guide you through the above steps and verbally ask you to confirm the details of your order. We reserve the right, at our sole discretion, to refuse, cancel or terminate orders at any time on reasonable grounds. For example, we may refuse, terminate or cancel your order in the event of an ongoing dispute regarding payment for a previous order or if we suspect, in our sole discretion, of (i) fraudulent activity; or (ii) any other violation of these General Terms & Conditions of Sale.
Prices, taxes & shipping costs
Unless otherwise specified, all prices indicated on the product pages of our Site or indicated by the Customer Relations Center include sales taxes/VAT applicable in France as well as shipping charges, but exclude all other taxes, in particular those potentially applicable in the country of shipment of the ordered product. We accept payments in euros and dollars. The applicable currency will be mentioned on your shopping cart before you finalize your order. You will need to carefully check the updated prices and the applicable currency. Sales or use taxes will vary depending on where the products are delivered. Shipping options and costs are described, if applicable, in the “Shipment” section indicated below or on the Sales Channels. Transport costs relating to the shipment of items ordered on the website are borne by the company and are not invoiced to customers, unless otherwise specified. We reserve the right to change prices and shipping charges at any time and without notice. We can offer a VAT refund mechanism if you decide to have the products shipped to certain European Union countries and, no later than thirty (30) days after, to transfer them outside the European Union under certain conditions. Such a mechanism will not be available to customers in the European Economic Area. For more details, please consult our FAQ section or contact our Customer Relations Center. We ensure that product prices are correct when the relevant information has been entered into the system or communicated to you via the Customer Relations Center. However, despite our reasonable efforts, it is always possible that the price of some of the products offered may not be accurate. If the price of any of the products you order or the shipping costs are incorrect, we will contact you as soon as possible to inform you of this error. If we are unable to contact you using the contact details you provided during the ordering process, we will cancel the order and notify you in writing. If we accept your order in error and process it when an error occurs in the indicated rates or shipping charges, we may cancel the supply of the product and refund the sums you have paid. Please note that changes to the law in effect between the date of placing your order and the date of receipt of a written Order and Shipping Confirmation may change the taxes associated to your order. If the resulting change results in an increase in the taxes charged to you, we will contact you and ask you to reconfirm your order.
Payment
We accept payment methods identified as part of the ordering process via Sales Channels. Depending on the means of payment, we may request additional information, including any special form of identification. When ordering on our Site, you will be asked to provide your payment details on the appropriate form. In the case of an order placed by telephone, you must provide your full payment details to the Customer Relations Center. All payment card holders are subject to a validation check and authorization procedure by the card issuer. If your payment card issuer refuses to authorize payment in our favor, you will need to contact them directly to resolve the problem. Other means of payment may also be subject to validation checks and an authorization procedure for payment system providers. You expressly authorize us to perform security checks if we deem it necessary, to transmit or occasionally obtain information (including updated information) about you to or from third parties, including but not limited to your payment card details, in order to authenticate your identity, validate your payment card, obtain initial payment card authorization and authorize individual purchase transactions. You can also pay a deposit. The total amount of your purchase will be blocked on your payment card until your order is shipped, at which time you will be notified of an Order and Shipping Confirmation and your payment card will be charged the applicable purchase price. If we use Stripe as a means of payment, the full amount of your purchase will be charged to your credit card immediately after placing your order. Prepayment will not affect your legal rights under these General Terms & Conditions of Sale (including, for example, any right to a refund). If we are unable to meet our shipping and/or delivery obligations set out below, we will inform you by email and refund the prepayment without delay. We can accept any bank transfer in payment of orders at our sole discretion. We do not charge a bank transfer commission for any order placed through the Sales Channels or the Customer Relations Center. However, some banks may charge bank transfer fees. We require that all orders paid by bank transfer and placed by telephone be confirmed through an order approval process. We can acknowledge receipt of an order paid by bank transfer but the order will only be processed after we have received payment and confirmed receipt by email. If your bank transfer is not credited to our bank account within seven (7) days of placing your order, your order will be canceled.
Order acknowledgement receipt
Once you have made your choice and placed your order on our Site, you will receive an Order Acknowledgment Receipt (by email or otherwise, confirming the details of your order and an order reference number). Be sure to keep this order reference number for any subsequent request or search for information about your order. This Order Acknowledgment Receipt does not constitute acceptance of your order. To confirm the order, we will perform standard legal controls in the areas of credit, anti-fraud and security, as well as related controls, and if they are satisfactory, we will then process your order. Upon receipt of the Order Acknowledgment Receipt, it is your responsibility to verify it and confirm that it accurately reflects your order intentions. If you have any questions or concerns or if the Order Acknowledgement Receipt does not reflect your intentions, you should contact us promptly at cercle@trilobe.com These General Terms & Conditions of Sale will be provided to you as soon as we acknowledge receipt of your order.
Shipping policy
We only accept orders to be delivered to the identified country(ies) during the Ordering Process. Please note that we do not ship products to certain addresses, such as military zones, restricted areas, collection points or PO boxes. For more information, please visit our FAQ section or contact us at cercle@trilobe.com Withdrawals from our showroom can be offered free of charge. Please refer to our “Shipment” section or contact us at cercle@trilobe.com for more information. We will inform you by email or telephone when the product is ready for collection. However, we remind you that each limited edition is the subject of a handing over ceremony. Should you be unable or unwilling to attend the ceremony, shipping will only be possible after the discount event as stated on your order form. If you order several products, we will only ship the order once all the products are available (there will be no partial shipments unless you have been informed to the contrary).
Order & Shipping confirmation
We will send you an Order & Shipping Confirmation in writing (by email or otherwise) at the time of shipment of your order. This Order & Shipping Confirmation is an acceptance of your order by us, indicating the existence of a legally binding sales contract.
Shipment
We will make reasonable efforts to ensure that the shipment is made by the carrier within the estimated delivery time from the date of our written Shipping Confirmation and in any event within thirty (30) days of that date, unless your purchase is for a product or service that will require additional shipping time as we have explained to you, for example, in the case of products or services that we customize or manufacture following your instructions. When confirming your order on our Site, we will inform you of an estimated delivery date (+/-7 days). If the shipment of products is delayed by an event that is beyond our control, we will inform you as soon as possible and make every reasonable effort to minimize the consequences of the delay. If we do not deliver within thirty (30) days of the date of the written Shipping Confirmation or such other period as we may specify, you may contact the Customer Relations Center to cancel the relevant order and obtain a refund of any amounts you have paid us as a deposit for any products you have not received. In any event, your right to cancel an order and to receive a refund of the sums you have paid to us as a deposit for any products you have not received is your sole remedy if we do not deliver the order in question. When assessing your shipment time, please take into account the payment approval time, address verification, security checks and order processing. Please note that delivery is always subject to receipt of your full payment. We will require a handwritten or electronic signature from you or from any person at the indicated shipping address (unless you make other arrangements) to confirm the shipment of each product, after which the risk and liability for the products you have purchased are transferred to you. If you have indicated a recipient other than yourself for shipment (for example, in case of a gift), you understand and agree that a signature of such recipient (or a person at the shipping address) constitutes proof of shipment and payment of the sales contract by Trilobe, involving a transfer of responsibility to the recipient’s address, as if the product had been shipped to you. For certain product categories, we reserve the right to request an identity check for verification purposes at the time of shipment. Invoices
After ordering products from our Site, you will receive an invoice that will be sent to you in writing (to your email address as a PDF attachment or otherwise).
Returns & exchanges policy
(a) Right of Cancellation: You have the right to cancel the contract created by our written order confirmation without stating a reason fourteen (14) days from the date you purchase, or any person you appoint (other than the carrier) acquires physical possession of the products in your order. If you are a customer located in the European Union or the European Economic Area and you have made a purchase through our Site, this must be considered as your legal right of withdrawal. In order to comply with the withdrawal period, you only need to withdraw before the expiry of the aforementioned period. To cancel the contract and return your product(s), you can contact our Customer Relations Center and follow the instructions given to you, or you can send us a clear written statement, such as a letter or email, to: cercle@trilobe.com. You can also cancel using the Cancellation Form Template but this is not mandatory.
(b) Return Process: Products that have been purchased through the Site, in a showroom or by telephone may only be returned to our returns address, as provided in our FAQ section, either through our Customer Relations Center or, if applicable, in accordance with these General Terms & Conditions of Sale. To return a product, you must follow the steps below: Call the Customer Relations Center:
(i) agree on a withdrawal date with our logistics partner. You may be asked at this stage to provide information about the product so that we can make a first assessment of its condition;
(ii) the Customer Relations Center will send you a return form by email;
(iii) complete the information requested on the return form and sign it;
(iv) you must include in the packaging the return form completed with the product and all its accessories, the free items you received as part of your order, the Service Guide, the Warranty Card and all other documents, in their original box; (v) close the packaging back
(vi) on the agreed date, our logistics partner will bring you the prepaid bill of lading and collect the closed package… You must keep proof of the return shipment as we decline any responsibility in the event that you are unable to provide such proof. Only goods received by the Trilobe Distribution Center will be eligible for a refund or exchange. If available, you can return the product to our Trilobe showroom in France. For more information, please refer to our FAQ section or call the Customer Relations Center. You may be asked to provide information about the products so that we can make an initial assessment of their condition.
(c) Product Return Conditions: We will verify that the returned product meets the conditions of the Returns and Exchanges Policy and, if so, we will proceed with the applicable refund or exchange. All our products must be returned in new, undamaged and perfect condition, with all protective materials in place and accompanied by the labels and stickers affixed thereto (if applicable) as well as the original Trilobe box and packaging, including all accessories and documents. For example, watch wristbands that have been paid for at your request must be returned with exactly the same number of links as in the original packaging. We reserve the right not to accept any return if the product shows signs of usury, or has been worn, used or altered from its original condition in any way or, we may reduce the amount of any applicable refund or exchange accordingly. If you have received free items as part of your order, they must be returned with the products. All returns will be subject to rigorous Quality Control (“QC”) by us to ensure that the returned products comply with these quality requirements. If the products do not meet QC standards, we will refuse the return, and the products will be returned to you, at your expense. If the returned product meets the QC, we will proceed with the applicable refund or exchange. Failure to comply with these General Terms & Conditions of Sale will entitle us to refuse the returned product and return it to you, at your expense.
(d) Non-Exchangeable & Non-Refundable Products: Orders for products that have been customized in one way or another for you cannot be canceled and cannot be returned to us for an exchange or refund. These include products that have been engraved or resulting from special measures that have been sent to us as part of your order.
(e) Refunds: You may return a product purchased through our Sales Channels for a refund, provided that the return complies with these General Terms & Conditions of Sale, in particular (a) the Right of Cancellation and (b) the Return Process above. Only the buyer shall be entitled to receive a refund of the purchase price. A person who has received the product as a gift (e.g. the “Gift Recipient”) will under no circumstances be entitled to receive a refund. If you are a Gift Recipient and wish to return a product, please contact the Customer Relations Center to discuss the options available to you. If the return complies with these General Terms & Conditions of Sale, we will make reasonable efforts to refund the purchase price to the buyer using the same method of payment as the one used to settle the original transaction within fourteen (14) days of receiving the product returned to Trilobe. Except in the case of a delivery of a defective product from us, the initial shipping costs will not be refunded. If the return does not comply with these General Terms & Conditions of Sale, you will not be entitled to a refund. If you have any questions, please contact the Customer Relations Center.
(f) Exchanges: You may return a product purchased through the Sales Channels and exchange it for another Trilobe product, provided that the return complies with these General Terms & Conditions of Sale, in particular (a) the Right of Cancellation and (b) the Return Process above. In all cases, the sale of the returned product will be canceled and a new order of the ordered product must be placed. If a product must be returned to Trilobe to be exchanged for a less expensive product, only the buyer of the returned product will be entitled to a refund of the price difference. If a product is returned in order to exchange it for a more expensive product, you will have to pay the price difference.
Force majeure
Trilobe’s liability is expressly excluded, and a breach of its obligations or a breach of these GTCS cannot be invoked against Trilobe in the event of loss, damage or delay suffered by the Customer resulting from causes beyond Trilobe’s control, such as, in particular and without limitation, cases of force majeure, wars, invasions, insurrections, riots, civil or military wars, floods, fires, natural disasters, explosions, government actions, terrorist threats and acts, national emergencies, revolutions, epidemics, lockouts, strikes and other worker protests (whether related to Trilobe workers or not), carrier constraints or delays, inability or delay in obtaining adequate and suitable materials, telecommunication failures or power failures. By accepting the Product upon receipt, the Customer is deemed to have waived all claims against Trilobe for loss or damage resulting from any delay in delivery.
Manufacturer's warranty & consumer's legal rights
We are committed to ensuring that each product strictly complies with our quality criteria and has passed all our controls, both technical and aesthetic. The selected products are covered by the applicable Trilobe Warranty. If you wish to repair a product covered by the applicable Trilobe Warranty, please refer to the applicable Trilobe Warranty and call our Customer Relations Center for more information. As a consumer, you may have legal rights under applicable legislation governing the sale of consumer goods; these rights are not affected by these General Terms & Conditions of Sale or the applicable Trilobe Warranty.
Free services
The following services can be offered free of charge, through the Sales Channels:
(a) Gift-wrapping paper & Packaging All orders will be shipped with the Trilobe gift box packed in special Trilobe packaging, as well as with a Trilobe shopping bag (if applicable).
(b) Engravings Engraving can be offered on particular products. If you wish to have a Trilobe product engraved, please provide the data to the Customer Relations Center or, if available, indicate it on the Site. Orders for customized Trilobe products are not cancellable and customized Trilobe products cannot be returned to Trilobe for exchange or refund.
(c) Wristband Exchange You can indicate your request on The Site, at the time of confirmation of your order. Therefore, wristbands will not be exchanged.
(d) Personalized Message You can personalize your order by adding a personalized message that Trilobe will print on a gift card included in your packaging. Trilobe reserves the right to reject any gift card message it deems offensive or inappropriate, to be written on Trilobe letterhead.

Product description
We make every effort to ensure that the information, including product descriptions, dimensions and colors, provided on the Site, or any other communication medium or communicated by the Customer Relations Center, is accurate and complete. However, we make no warranty, express or implied, as to the accuracy, reliability and completeness of this information.
Limitation of liability clause
To the fullest extent permitted by applicable law, we disclaim and exclude all other terms, conditions and warranties with respect to the products and Sales Channels, whether express or implied or otherwise, or arising from any prior transaction, use or business practice. Nothing in these General Terms & Conditions limits or excludes our liability for any liability that cannot be limited or excluded by applicable law. Subject to the preceding sentence, our total liability to you under these General Terms & Conditions of Sale in respect of any order, whether in contract, tort (including negligence) or otherwise, even if we have been advised of the possibility of such damages, shall in no event exceed one hundred percent (100%) of the price of the product(s) of your order. Please note that in some countries, consumer protection legislation may not provide for certain exclusions or limitations of warranties or liabilities, and therefore some of the above exclusions and limitations may not apply.
General provisions
If any provision, or part of a provision, of these General Terms & Conditions of Sale is found to be unlawful, void or unenforceable, such provision or part thereof shall be deemed not to form part of these General Terms & Conditions of Sale, and the legality, validity or enforceability of the remaining provisions of these General Terms & Conditions of Sale shall not be affected thereby, except as otherwise required by applicable law. These General Terms & Conditions of Sale (and the related terms incorporated by reference) constitute the entire agreement between you and us with respect to the order of products or services, and supersede all agreements, draft agreements, understandings, undertakings or ancillary contracts of any kind entered into by the parties, whether oral or written, with respect to that purpose. We decline any responsibility in the event of non-performance or delay in performance or failure to comply with our obligations under these General Terms & Conditions of Sale, arising from any cause beyond our control. Our waiver of any breach of any provision of these General Terms & Conditions shall not be construed as a waiver of any other or subsequent breach. This contract is between you and us. No other person shall have the right to enforce any of its conditions. However, if you purchase a product as a gift, the recipient of your gift will benefit from the applicable Trilobe Warranty.
Governing law & Jurisdiction
These General Terms & Conditions of Sale shall be governed by and interpreted in accordance with French law. The Selling Entity has its registered office, without reference to any provisions concerning a possible conflict of laws (“Applicable Laws”). Any dispute, controversy or claim arising out of or relating to the General Terms & Conditions of Sale, including the validity, invalidity, breach or termination of the General Terms & Conditions of Sale, shall be adjudicated or submitted to arbitration in accordance with the General Terms & Conditions of Sale. If the applicable law is different from the consumer law of your country, we will grant you similar protection. You may bring proceedings against us either in the courts of Paris or in the country where you reside. We may also bring proceedings against you in the courts of the country where you reside. Without any restriction on the bringing of any action before a court of the country in which the registered office of the Sales Entity is registered, you and Trilobe shall make every effort for a period of thirty (30) days to settle amicably any dispute or disagreement arising out of or related to the product, the General Terms & Conditions of Sale or any failure to comply therewith. If you are a consumer residing in the European Union, you have the right to submit your complaint to an Alternative Dispute Resolution institution. Sales warranty
1 – Our Trilobe Watches In order to benefit from the international warranty, Trilobe products must have been purchased exclusively on our Site, from an authorized Trilobe dealer or from our Trilobe showroom. Maintenance and repairs of your watch should be carried out by the Trilobe Service Center. If these conditions are not met, the manufacturer’s warranty cannot apply. This international warranty applies to Trilobe products sold or sent for repair under warranty in all countries
2 – Trilobe International Warranty Terms & Conditions Your Trilobe watch is guaranteed against any manufacturing defect for two years from the date of hand delivery, under the following conditions. Any part that our technical services consider defective due to a manufacturing defect will be repaired or replaced free of charge. This assessment is at Trilobe’s sole discretion. The Trilobe International Warranty is only valid if the warranty certificate provided with this booklet has been duly completed, dated, stamped and signed by Trilobe. Waterproof Trilobe watches can be identified by the symbol engraved on the back. They are water-resistant for two years from the date of hand-delivery, provided that the glass, bezel, back, case back, case middle and crown have not been damaged. However, it is essential to have the water-resistance of your watch checked at least once every two years and in any case before a period of heavy use by our Trilobe Service Center (for
more information, please consult the user manual) or if the warranty card is activated.
3 –Limited Warranty Policy This Trilobe International Warranty does not cover defects resulting from accidents, improper handling or improper or abusive use (such as impacts, impact marks, crushing, excessive temperatures, strong magnetic fields), unauthorized modification or repair, as well as the consequences of normal wear and tear and aging of the watch, wristband and glass, loss of water-resistance beyond two years from date of purchase if your watch is waterproof. Any intervention on the watch outside our approved Trilobe network cancels the
warranty.
4 – Technical Warranty After any intervention carried out with an approved Trilobe repairer, the work carried out is guaranteed for a period of 12 months. This warranty does not cover normal wear and tear or damage resulting from improper handling. In the event of damage caused by an
unauthorized repairer, the watch must be repaired at your expense.
5 – Trilobe Customer Service A Trilobe watch is a high-precision instrument that operates 24 hours a day, for a total of about 8’760 hours per year. It is therefore essential to schedule an interview every three years to ensure its proper functioning and lifetime. If you notice significant variations in functioning, it is necessary to have your movement revised. It is also advisable to have the water-resistance of your watch checked every two years or before any period during which it will be subjected to prolonged and/or regular immersion. Maintenance and repairs should be carried out by the Trilobe Service Center. Our approved Service Center is managed by watchmakers trained at Manufacture Trilobe and has the facilities, tools and components necessary for the repair and maintenance of Trilobe watches.
